Legitify - updating the International Notarizing Service
by Arco Ganguli, edited by Dr L S Spedding
Background
Notarization is a vital and tried and tested service or process that has been relied on since antiquity to validate and authenticate the identities and veracity of commercial and professional transactions and documentation. Once the global trade routes were established, there was a need for international processes for the validation of commercial identities and cross-border transactions. Thus, the domestic notarial seals were relied upon at an international level. Although the domestic laws were different, the notarial seal became the international standard for all forms of commercial third-party authentication services, even though the actual qualification to notarise varied. Today, the world has evolved further, and technology has connected us to the point where international travel for commercial transactions has become less and less essential. Therefore, there has been creative and practical innovation in this space as well by Legitify to notarize documents:
- Remotely;
- Anytime; and
- Anywhere
An Introduction to Legitify
Founded in 2020 by a diverse global team, Legitify is an early mover for Remote Online Notarization (RON) in Europe and non-US global markets. The company’s passion about innovation and digitalizing legal services has materialized using emerging disruptive technologies. Legitify has built an AI-powered solution using audio-video authentication that allows customers to notarize documents remotely anywhere - which is particularly important in these times during and post COVID.
How will this be of help to Women Practitioners of Law?
Women in Law International has interviewed the Author - and co-Founder of Legitify- about the values of this technology. We should take into consideration how the remote online notarization solution has disrupted the US and international markets. It has not only made this process much more cost effective, it has also helped save valuable time and providing convenience, where an in person process can be carried out from home. This is especially helpful for women legal practitioners when they are working from home.
It has also resulted in democratizing the notarial profession insofar as there is now a trend that more and more people are joining the notary profession and address the primary gender gap in this traditional profession.
Mission of Legitify
Legitify’s mission is to provide an end-to-end platform for third party authentication and validation in Europe and beyond arose out of necessity. Traditionally, notarizing documents requires the signer(s) to appear in person in front of a Notary Public. Both notaries and companies have an interest in making notarization as efficient as possible. The need for a shift in notarial processes was of course amplified through the COVID-19 restrictions, resulting in an increased need for remote solutions and digitalization of the industry. The legal framework is changing in order to adapt to new challenges. In accordance with EU Commission Directive 2019/1151, European Union Member States are required to update their notarization laws to permit the formation of companies online. More than 50 per cent of the Member States have already transposed the changes evidently.
Legitify provides solutions to help customers and notaries navigate the changing environment. The solutions improve a company’s efficiency and agility, saving precious time during each transaction. Using Remote Online Notarization (RON) instead of traditional in-person notarization, saves valuable resources and is particularly convenient when the notarization involves parties who are in different locations, be it different regions or states. Furthermore, digitization allows for less printing and paper use, which makes it more environmentally friendly and reduces operating expenses. The legal profession has had to embrace soft copies in many aspects of its services in today’s world and this service is very complementary to the fulfilment of this requirement. Most importantly, using online technologies like digital certificates, and AI-powered identity proofing and credential analysis ensures safety of the notarization and compliance with the regulations surrounding it.
How to use the service and logistics - simple steps in legal technology
The notarization process starts with the verification of each party’s identity using AI technology. Thereafter, documents are uploaded and an appointment with the notary is scheduled. At the time of the appointment, customers connect with the notary remotely online, via real-time audio-video connection. Once finalized, the customers receive the notarized documents.
